{"id":9891,"date":"2019-12-06T00:00:00","date_gmt":"2019-12-06T00:00:00","guid":{"rendered":"https:\/\/abeille-preprod.eliott-markus.cloud\/tolerance-zero-alcool\/"},"modified":"2019-12-06T00:00:00","modified_gmt":"2019-12-06T00:00:00","slug":"tolerance-zero-alcool","status":"publish","type":"post","link":"https:\/\/abeille.law\/en\/tolerance-zero-alcool\/","title":{"rendered":"Quand la tol\u00e9rance z\u00e9ro alcool s\u2019invite dans le r\u00e8glement int\u00e9rieur"},"content":{"rendered":"<p>En mati\u00e8re d\u2019alcool, le Code du travail tol\u00e8re l\u2019introduction et la consommation de vin, de bi\u00e8re, de cidre et de poir\u00e9 sur les lieux de travail. Toutefois, les employeurs sont autoris\u00e9s, via leur r\u00e8glement int\u00e9rieur ou une note de service, \u00e0 prendre des mesures plus restrictives, c\u2019est-\u00e0-dire \u00e0 limiter la consommation d\u2019alcool dans l\u2019entreprise, pour prot\u00e9ger la sant\u00e9 et la s\u00e9curit\u00e9 de leurs salari\u00e9s. Ils peuvent m\u00eame, en cas de situation particuli\u00e8re de danger ou de risque, interdire purement et simplement la consommation d\u2019<strong>alcool au travail<\/strong>. Mais encore faut-il que cette mesure soit justifi\u00e9e par la nature des t\u00e2ches \u00e0 accomplir et proportionn\u00e9e au but recherch\u00e9. Et, sur ce point, les juges viennent d\u2019apporter quelques pr\u00e9cisions\u2026<\/p>\n<p>Dans une affaire r\u00e9cente, un \u00e9quipementier automobile avait modifi\u00e9 son r\u00e8glement int\u00e9rieur afin d\u2019y inclure une disposition soumettant les salari\u00e9s occupant \u00ab\u00a0<em>des postes de s\u00fbret\u00e9 et de s\u00e9curit\u00e9 ou \u00e0 risque<\/em>\u00a0\u00bb \u00e0 une \u00ab\u00a0<em><strong>tol\u00e9rance z\u00e9ro alcool<\/strong>\u00a0<\/em>\u00bb. La liste des postes concern\u00e9s par cette mesure (conducteurs d\u2019engins de certains types, m\u00e9caniciens, \u00e9lectriciens\u2026) figurait dans une annexe du r\u00e8glement. Estimant que la d\u00e9cision de l\u2019employeur d\u2019interdire la consommation d\u2019alcool \u00e0 certains employ\u00e9s n\u2019\u00e9tait pas justifi\u00e9e, l\u2019inspection du travail avait exig\u00e9 le retrait de cette disposition du r\u00e8glement int\u00e9rieur.<\/p>\n<p>Saisi du litige, le <a title=\"Legifrance | Conseil d'Etat n\u00b0420434\" href=\"https:\/\/www.legifrance.gouv.fr\/affichJuriAdmin.do?idTexte=CETATEXT000038738016\" target=\"_blank\" rel=\"noopener\">Conseil d\u2019\u00c9tat<\/a> a pr\u00e9cis\u00e9 que l\u2019employeur a la possibilit\u00e9, en cas de danger particuli\u00e8rement \u00e9lev\u00e9 pour les salari\u00e9s ou pour les tiers, d\u2019interdire toute impr\u00e9gnation alcoolique des salari\u00e9s concern\u00e9s. Les juges ont affirm\u00e9 que le r\u00e8glement int\u00e9rieur peut se borner \u00e0 fixer la liste des postes de travail concern\u00e9s par la restriction sans comporter d\u2019autres \u00e9l\u00e9ments d\u2019explication.
