En effet, pour mettre en place un tel dispositif, l\u2019employeur doit justifier d\u2019un objectif l\u00e9gal et l\u00e9gitime, par exemple, pour assurer la s\u00e9curit\u00e9 des biens et des personnes. Et la vid\u00e9osurveillance ne doit pas aboutir, sauf circonstances particuli\u00e8res (manipulation d\u2019argent, entrep\u00f4t stockant des biens de valeur\u2026), \u00e0 filmer les salari\u00e9s sur leur poste de travail. Des r\u00e8gles qui semblent avoir \u00e9t\u00e9 quelque peu oubli\u00e9es par une soci\u00e9t\u00e9 qui vient d\u2019\u00eatre condamn\u00e9e par la Cnil \u00e0 ce titre&#8230;<\/p>\n<p>Dans cette affaire, une soci\u00e9t\u00e9, dont l\u2019activit\u00e9 consistait en la traduction asserment\u00e9e et libre de documents, avait eu recours \u00e0 un syst\u00e8me de vid\u00e9osurveillance compos\u00e9 de trois cam\u00e9ras. L\u2019une d\u2019entre elles, install\u00e9e dans le bureau des traducteurs, filmait en continu six salari\u00e9s et une armoire contenant des documents de <a title=\"Abeille &#038; Associ\u00e9s | Droit du travail\" href=\"fr\/domaines-competences\/droit-travail-protection-sociale\">travail<\/a> de la soci\u00e9t\u00e9.<\/p>\n<p>Saisie de plusieurs plaintes, la <strong>Cnil<\/strong> avait, \u00e0 plusieurs reprises, contr\u00f4l\u00e9 la soci\u00e9t\u00e9. Les proc\u00e8s-verbaux \u00e9tablis au terme de ces contr\u00f4les avaient relev\u00e9 plusieurs manquements\u00a0: les salari\u00e9s n\u2019avaient pas \u00e9t\u00e9 formellement inform\u00e9s du dispositif de vid\u00e9osurveillance, la dur\u00e9e de conservation des donn\u00e9es recueillies \u00e9tait excessive, l\u2019acc\u00e8s aux postes informatiques des salari\u00e9s n\u2019\u00e9tait pas s\u00e9curis\u00e9. Par ailleurs, ces derniers \u00e9taient plac\u00e9s sous surveillance constante, ce qui, pour la Cnil, constituait une mesure manifestement disproportionn\u00e9e et excessive par rapport au but poursuivi, \u00e0 savoir la s\u00e9curit\u00e9 des biens et des personnes. Et aucune circonstance exceptionnelle justifiant de filmer constamment les salari\u00e9s n\u2019avait \u00e9t\u00e9 d\u00e9montr\u00e9e par la <a title=\"Abeille &#038; Associ\u00e9s | Droit des affaires et soci\u00e9t\u00e9s\" href=\"fr\/domaines-competences\/droit-affaires-contrats-societe\">soci\u00e9t\u00e9<\/a>.<\/p>\n<p>Malgr\u00e9 plusieurs mises en demeure de s\u2019ex\u00e9cuter, la soci\u00e9t\u00e9 ne s\u2019\u00e9tait pas pli\u00e9e, ou alors de mani\u00e8re tr\u00e8s tardive, aux exigences de la Cnil.
