{"id":9853,"date":"2019-07-15T00:00:00","date_gmt":"2019-07-15T00:00:00","guid":{"rendered":"https:\/\/abeille-preprod.eliott-markus.cloud\/rupture-conventionnelle-salarie-inapte\/"},"modified":"2019-07-15T00:00:00","modified_gmt":"2019-07-15T00:00:00","slug":"rupture-conventionnelle-salarie-inapte","status":"publish","type":"post","link":"https:\/\/abeille.law\/en\/rupture-conventionnelle-salarie-inapte\/","title":{"rendered":"Rupture conventionnelle avec un salari\u00e9 d\u00e9clar\u00e9 inapte"},"content":{"rendered":"<p>Un employeur peut signer une <strong>rupture conventionnelle<\/strong> avec un <strong>salari\u00e9 d\u00e9clar\u00e9 inapte par le m\u00e9decin du travail<\/strong>.<\/p>\n<p>Depuis plus de\u00a010\u00a0ans, la rupture conventionnelle homologu\u00e9e permet \u00e0 un employeur et \u00e0 un salari\u00e9 de rompre d\u2019un commun accord un <a title=\"Abeille &#038; Associ\u00e9s | Droit affaires et des contrats\" href=\"fr\/domaines-competences\/droit-affaires-contrats-societe\">contrat de travail<\/a> \u00e0 dur\u00e9e ind\u00e9termin\u00e9e moyennant la signature d\u2019une convention de rupture et son homologation par la Direccte.<\/p>\n<p>Les tribunaux ont admis qu\u2019un employeur pouvait conclure une rupture conventionnelle notamment avec un <strong>salari\u00e9 en arr\u00eat de travail<\/strong> en raison d\u2019un accident relevant de la vie priv\u00e9e ou d\u2019une maladie d\u2019origine personnelle, mais aussi d\u2019un accident du travail ou d\u2019une maladie professionnelle ou encore avec un salari\u00e9 en cong\u00e9 de maternit\u00e9 ou en cong\u00e9 parental d\u2019\u00e9ducation.<\/p>\n<p>Et la Cour de cassation vient de reconna\u00eetre qu\u2019il est possible de rompre, par une rupture conventionnelle, le contrat de travail d\u2019un salari\u00e9 d\u00e9clar\u00e9 inapte \u00e0 occuper son poste par le m\u00e9decin du <a title=\"Abeille &#038; Associ\u00e9s | Droit du travail\" href=\"fr\/domaines-competences\/droit-travail-protection-sociale\">travail<\/a>.<\/p>\n<p>Dans cette affaire, une salari\u00e9e victime d\u2019un accident du travail en juillet\u00a02011 avait, mi-avril\u00a02014, \u00e9t\u00e9 d\u00e9clar\u00e9e inapte \u00e0 occuper son poste de travail. Le 25\u00a0avril\u00a02014, elle avait sign\u00e9 avec son employeur une convention de rupture conventionnelle qui avait \u00e9t\u00e9 homologu\u00e9e par la Direccte.<\/p>\n<p>Par la suite, la salari\u00e9e avait contest\u00e9 en justice la validit\u00e9 de cette rupture conventionnelle. Elle estimait que celle-ci avait \u00e9t\u00e9 conclue en violation des obligations impos\u00e9es \u00e0 l\u2019employeur lorsqu\u2019un de ses salari\u00e9s est d\u00e9clar\u00e9 inapte et notamment de son obligation de lui proposer un emploi de reclassement.<\/p>\n<p>Des arguments qui n\u2019ont pas \u00e9t\u00e9 retenus par la Cour de cassation.
