Au moment de la conclusion d\u00e9finitive de la vente devant le notaire, l\u2019<strong>acqu\u00e9reur<\/strong> avait refus\u00e9 de signer car l\u2019acte authentique signalait l\u2019existence d\u2019une <strong>proc\u00e9dure en cours<\/strong> pour des nuisances diverses et r\u00e9p\u00e9t\u00e9es d\u2019un copropri\u00e9taire, voisin de palier. Une information qui n\u2019avait jamais \u00e9t\u00e9 communiqu\u00e9e \u00e0 l\u2019acqu\u00e9reur jusqu\u2019alors. Par la suite, le vendeur avait assign\u00e9 en justice l\u2019acqu\u00e9reur en paiement du montant de la clause p\u00e9nale pr\u00e9vue dans l\u2019acte de vente.<\/p>\n<section class=\"annotation\">\n<ul>\n<li>\u00c0 noter\u00a0:\u00a0une clause p\u00e9nale, pr\u00e9vue dans le compromis de vente, d\u00e9termine \u00e0 l\u2019avance le montant de la sanction p\u00e9cuniaire inflig\u00e9e \u00e0 l\u2019acqu\u00e9reur qui n\u2019ex\u00e9cuterait pas son engagement.<\/li>\n<\/ul>\n<\/section>\n<p>Saisis de cette affaire, les juges ont rejet\u00e9 la demande du vendeur et prononc\u00e9 la nullit\u00e9 de la promesse de vente. Une d\u00e9cision motiv\u00e9e par le fait que le consentement de l\u2019acqu\u00e9reur lors de la vente avait \u00e9t\u00e9 vici\u00e9 (par un dol, c\u2019est-\u00e0-dire par des man\u0153uvres frauduleuses ayant pour objet de tromper l\u2019une des parties \u00e0 l\u2019acte sur un \u00e9l\u00e9ment d\u00e9terminant en vue d\u2019obtenir son consentement). En effet, lors des visites de l\u2019appartement, le vendeur avait assur\u00e9 \u00e0 l\u2019acqu\u00e9reur qu\u2019il n\u2019existait aucun probl\u00e8me de voisinage.
