Et si celui-ci ne se r\u00e9installe pas\u00a0?<\/p>\n<p>Le propri\u00e9taire d\u2019un local est en droit de refuser le renouvellement du bail commercial qu\u2019il a pr\u00e9c\u00e9demment consenti au locataire. Mais, en principe, il doit alors lui payer une indemnit\u00e9 dite \u00ab\u00a0<em>d\u2019<strong>\u00e9viction<\/strong><\/em>\u00a0\u00bb qui est cens\u00e9e r\u00e9parer le pr\u00e9judice caus\u00e9 par le d\u00e9faut de renouvellement. Cette somme comprend, outre la valeur marchande du fonds de commerce ainsi que les frais et droits de mutation \u00e0 payer pour un fonds de m\u00eame valeur, des frais de d\u00e9m\u00e9nagement et de r\u00e9installation.<\/p>\n<p>Toutefois, comme l\u2019a r\u00e9cemment pr\u00e9cis\u00e9 la <a title=\"Legifrance | Arr\u00eat de la Cour de cassation\" href=\"https:\/\/www.legifrance.gouv.fr\/affichJuriJudi.do?oldAction=rechJuriJudi&#038;idTexte=JURITEXT000038373288&#038;fastReqId=1040774014&#038;fastPos=1\" target=\"_blank\" rel=\"noopener\">Cour de cassation<\/a>, lorsqu\u2019un locataire ne se r\u00e9installe pas, rien ne peut emp\u00eacher son ancien bailleur de lui demander de rembourser les frais de r\u00e9installation vers\u00e9s. Pas m\u00eame la d\u00e9cision de justice, pourtant irr\u00e9vocable, qui a attribu\u00e9 cette somme au locataire.<\/p>\n<p>En effet, la Cour consid\u00e8re que des \u00e9v\u00e9nements post\u00e9rieurs \u00e0 cette d\u00e9cision (le fait que le locataire ne se soit pas r\u00e9install\u00e9) ont modifi\u00e9 la situation ant\u00e9rieurement reconnue par le juge. Le locataire ne peut donc pas invoquer l\u2019autorit\u00e9 attach\u00e9e \u00e0 cette d\u00e9cision pour s\u2019opposer \u00e0 la revendication du bailleur.
