Toutefois, \u00e0 condition d\u2019obtenir l\u2019accord de son repr\u00e9sentant l\u00e9gal et l\u2019autorisation pr\u00e9alable de l\u2019inspection du travail, vous avez la possibilit\u00e9 d\u2019employer un jeune de plus de 14\u00a0ans et de moins de 16\u00a0ans pour accomplir des travaux l\u00e9gers et adapt\u00e9s \u00e0 son \u00e2ge pendant une partie de ses vacances scolaires. Mais attention, cette p\u00e9riode de travail ne doit pas exc\u00e9der la moiti\u00e9 de ses vacances, soit un mois de travail au plus pour 2\u00a0mois de vacances.<\/p>\n<h2 class=\"title\">Un contrat en bonne et due forme<\/h2>\n<p>Quelle que soit la dur\u00e9e de son s\u00e9jour dans votre entreprise, le jeune recrut\u00e9 dans le cadre d\u2019un job d\u2019\u00e9t\u00e9 doit signer un <strong>contrat de travail<\/strong> \u00e0 dur\u00e9e d\u00e9termin\u00e9e. Un contrat qui doit pr\u00e9ciser, en particulier, le motif de sa signature (accroissement temporaire d\u2019activit\u00e9, remplacement d\u2019un salari\u00e9 absent\u2026), son terme ou sa dur\u00e9e minimale ainsi que le poste de travail concern\u00e9.<\/p>\n<section class=\"annotation\">\n<blockquote><p>Pr\u00e9cision\u00a0:\u00a0la conclusion d\u2019un <a title=\"cabinet Abeille | droit du travail\" href=\"fr\/domaines-competences\/droit-travail-protection-sociale\">contrat de travail<\/a> avec un mineur suppose l\u2019<strong>accord du repr\u00e9sentant l\u00e9gal<\/strong>.<\/p><\/blockquote>\n<\/section>\n<h2 class=\"title\">Une r\u00e9mun\u00e9ration bas\u00e9e sur le Smic<\/h2>\n<p>Votre jeune recrue a normalement droit \u00e0 la m\u00eame r\u00e9mun\u00e9ration qui serait allou\u00e9e \u00e0 un salari\u00e9 de qualification \u00e9quivalente (dipl\u00f4me, exp\u00e9rience\u2026) embauch\u00e9 en contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9e pour exercer la m\u00eame fonction. Sachant que cette r\u00e9mun\u00e9ration ne peut pas \u00eatre inf\u00e9rieure au <strong>Smic<\/strong> ou au salaire minimal fix\u00e9 par votre convention collective.<\/p>\n<p>Une minoration du Smic est toutefois pr\u00e9vue pour les moins de 18\u00a0ans\u00a0: de 20\u00a0% pour les jeunes de moins de 17\u00a0ans et de 10\u00a0% pour ceux \u00e2g\u00e9s de\u00a017 \u00e0 18\u00a0ans. Un abattement qui ne s\u2019applique pas au jeune qui justifie de 6\u00a0mois de pratique dans votre branche professionnelle.<\/p>\n<section class=\"annotation\">\n<blockquote><p>\u00c0 savoir\u00a0:\u00a0les avantages accord\u00e9s aux autres salari\u00e9s de l\u2019entreprise, comme les titres-restaurant, b\u00e9n\u00e9ficient \u00e9galement aux jeunes recrut\u00e9s pour l\u2019\u00e9t\u00e9.<\/p><\/blockquote>\n<\/section>\n<h2 class=\"title\">Des conditions de travail am\u00e9nag\u00e9es<\/h2>\n<p>Les jeunes de moins de 18\u00a0ans ne peuvent pas travailler plus de 8\u00a0heures par jour (7\u00a0heures pour les moins de 16\u00a0ans), ni plus de 35\u00a0heures par semaine.
