Ce n\u2019est qu\u2019\u00e0 d\u00e9faut d\u2019emploi disponible ou en cas de refus des offres de reclassement par le salari\u00e9 que l\u2019association peut le licencier.<\/p>\n<p>Dans une affaire r\u00e9cente, une salari\u00e9e, engag\u00e9e comme \u00e9ducatrice dans une association g\u00e9rant un coll\u00e8ge priv\u00e9, avait \u00e9t\u00e9 licenci\u00e9e pour motif \u00e9conomique. Licenciement qu\u2019elle avait contest\u00e9 devant les tribunaux.<\/p>\n<p>Pour la Cour de cassation, le <a title=\"Plus d'informations sur le droit de la protection sociale\" href=\"fr\/domaines-competences\/droit-travail-protection-sociale\">licenciement de la salari\u00e9e<\/a> \u00e9tait effectivement sans cause r\u00e9elle et s\u00e9rieuse. En effet, deux postes d\u2019\u00e9ducateur \u00e9taient disponibles au sein de l\u2019association lors du licenciement de la salari\u00e9e. L\u2019un \u00e0 la suite du refus d\u2019une proposition de mutation par un cadre \u00e9ducatif et l\u2019autre, un contrat \u00e0 dur\u00e9e d\u00e9termin\u00e9e de 4\u00a0mois, en raison de l\u2019acceptation d\u2019une formation par le salari\u00e9. Or l\u2019association n\u2019avait pas propos\u00e9 ces postes \u00e0 la salari\u00e9e avant de la licencier et, par cons\u00e9quent, elle n\u2019avait pas rempli son <strong>obligation de reclassement<\/strong>.
