{"id":9783,"date":"2019-04-15T00:00:00","date_gmt":"2019-04-15T00:00:00","guid":{"rendered":"https:\/\/abeille-preprod.eliott-markus.cloud\/biometrie-en-entreprise\/"},"modified":"2019-04-15T00:00:00","modified_gmt":"2019-04-15T00:00:00","slug":"biometrie-en-entreprise","status":"publish","type":"post","link":"https:\/\/abeille.law\/en\/biometrie-en-entreprise\/","title":{"rendered":"Biom\u00e9trie dans l\u2019entreprise : les r\u00e8gles \u00e0 respecter"},"content":{"rendered":"<p>La Cnil publie son r\u00e8glement type sur l\u2019<strong>utilisation de la biom\u00e9trie<\/strong> par les employeurs.<\/p>\n<p>Si les employeurs peuvent mettre en place dans leur entreprise des dispositifs biom\u00e9triques, c\u2019est-\u00e0-dire des dispositifs d\u2019identification des salari\u00e9s bas\u00e9s sur leurs caract\u00e9ristiques physiques, physiologiques ou comportementales (empreintes digitales, r\u00e9seau veineux de la main, iris, contour du visage ou de la main, voix\u2026), encore faut-il qu\u2019ils respectent des r\u00e8gles qui viennent d\u2019\u00eatre mises \u00e0 jour par la Commission nationale de l\u2019informatique et des libert\u00e9s (<strong>Cnil<\/strong>).<\/p>\n<section>\n<blockquote><p>Attention :\u00a0avant de mettre en place un dispositif biom\u00e9trique dans son entreprise, l\u2019employeur doit informer et consulter le comit\u00e9 social et \u00e9conomique. Il doit \u00e9galement informer individuellement et par \u00e9crit chaque salari\u00e9 concern\u00e9 avant de recueillir ses donn\u00e9es biom\u00e9triques.<\/p><\/blockquote>\n<\/section>\n<h2 class=\"title\">Dans quel but\u00a0?<\/h2>\n<p>L\u2019employeur peut installer un dispositif d\u2019identification biom\u00e9trique pour contr\u00f4ler l\u2019acc\u00e8s \u00e0 des locaux devant faire l\u2019objet d\u2019une restriction de circulation et\/ou \u00e0 des appareils et applications informatiques professionnels.<\/p>\n<p>Pour cela, il doit d\u00e9montrer la n\u00e9cessit\u00e9 d\u2019utiliser les donn\u00e9es biom\u00e9triques de ses salari\u00e9s. Il doit donc \u00eatre en mesure d\u2019expliquer pourquoi le recours \u00e0 d\u2019autres dispositifs d\u2019identification tels que des badges ou des mots de passe ou \u00e0 des mesures organisationnelles et techniques de protection ne permet pas d\u2019atteindre le niveau de s\u00e9curit\u00e9 exig\u00e9.<\/p>\n<p>Enfin, avant d\u2019instaurer un dispositif biom\u00e9trique, l\u2019employeur doit r\u00e9aliser une analyse d\u2019impact relative \u00e0 la protection des donn\u00e9es qui consiste \u00e0 identifier les risques pour les droits et libert\u00e9s des salari\u00e9s et, au besoin, y rem\u00e9dier.<\/p>\n<h2 class=\"title\">Quelles donn\u00e9es biom\u00e9triques\u00a0?<\/h2>\n<p>L\u2019authentification biom\u00e9trique install\u00e9e dans l\u2019entreprise ne peut \u00eatre bas\u00e9e que sur des <strong>caract\u00e9ristiques morphologiques des salari\u00e9s<\/strong>.
