{"id":9706,"date":"2019-03-21T00:00:00","date_gmt":"2019-03-21T00:00:00","guid":{"rendered":"https:\/\/abeille-preprod.eliott-markus.cloud\/conge-presence-parentale\/"},"modified":"2019-03-21T00:00:00","modified_gmt":"2019-03-21T00:00:00","slug":"conge-presence-parentale","status":"publish","type":"post","link":"https:\/\/abeille.law\/en\/conge-presence-parentale\/","title":{"rendered":"Un cong\u00e9 de pr\u00e9sence parentale plus favorable pour les salari\u00e9s"},"content":{"rendered":"<p>Le salari\u00e9 dont l\u2019enfant est victime d\u2019une maladie, d\u2019un handicap ou d\u2019un accident graves n\u00e9cessitant une pr\u00e9sence soutenue et des soins contraignants b\u00e9n\u00e9ficie d\u2019un <strong>cong\u00e9 de pr\u00e9sence parentale<\/strong>. Un cong\u00e9 qui ne peut exc\u00e9der 310\u00a0jours ouvr\u00e9s (cons\u00e9cutifs ou non) sur une p\u00e9riode maximale de 3\u00a0ans, mais qui peut toutefois \u00eatre renouvel\u00e9 dans des conditions qui viennent d\u2019\u00eatre \u00e9largies.<\/p>\n<p>Ainsi, d\u00e9sormais, outre le cas de rechute ou de r\u00e9cidive de la pathologie de l\u2019enfant, le salari\u00e9 a <strong>droit au renouvellement du cong\u00e9<\/strong> de pr\u00e9sence parentale lorsque la gravit\u00e9 de cette pathologie n\u00e9cessite toujours une pr\u00e9sence soutenue et des soins contraignants.<\/p>\n<p>Comme pour le cong\u00e9 de pr\u00e9sence parentale initial, son renouvellement n\u00e9cessite un certificat m\u00e9dical qui pr\u00e9cise la dur\u00e9e pr\u00e9visible du traitement de l\u2019enfant. En outre, le salari\u00e9 doit informer son employeur (par lettre recommand\u00e9e avec avis de r\u00e9ception ou remise en mains propres contre r\u00e9c\u00e9piss\u00e9) de son souhait de prendre un cong\u00e9, initial ou renouvel\u00e9, au moins 15\u00a0jours avant son commencement. Et chaque fois qu\u2019il entend b\u00e9n\u00e9ficier d\u2019un ou de plusieurs jours de cong\u00e9, son employeur doit en \u00eatre averti au moins 48\u00a0heures \u00e0 l\u2019avance.<\/p>\n<p>Enfin, le cong\u00e9 de pr\u00e9sence parentale est aujourd\u2019hui pris en compte pour sa dur\u00e9e globale dans le calcul de l\u2019anciennet\u00e9 du salari\u00e9, et non plus pour moiti\u00e9 seulement.<\/p>\n<section>\n<ul>\n<li>Pr\u00e9cision\u00a0:\u00a0l\u2019employeur n\u2019a pas \u00e0 maintenir la r\u00e9mun\u00e9ration du salari\u00e9 pendant le cong\u00e9.
