{"id":9652,"date":"2020-07-31T00:00:00","date_gmt":"2020-07-31T00:00:00","guid":{"rendered":"https:\/\/abeille-preprod.eliott-markus.cloud\/droit-deconnexion-vacances\/"},"modified":"2020-07-31T00:00:00","modified_gmt":"2020-07-31T00:00:00","slug":"droit-deconnexion-vacances","status":"publish","type":"post","link":"https:\/\/abeille.law\/en\/droit-deconnexion-vacances\/","title":{"rendered":"Les salari\u00e9s fran\u00e7ais et le droit \u00e0 la d\u00e9connexion pendant les vacances"},"content":{"rendered":"<blockquote><p>Une \u00e9tude indique que 67 % des fran\u00e7ais ne parviennent pas \u00e0 d\u00e9crocher de leur travail pendant leurs vacances.<\/p><\/blockquote>\n<p>89 % des femmes et 85 % des hommes trouvent que le\u00a0travail est bien plus pr\u00e9sent qu&#8217;auparavant pendant leurs vacances.<\/p>\n<p>De plus en plus de <strong>salari\u00e9s<\/strong> n&#8217;arrivent plus \u00e0 <strong>d\u00e9connecter apr\u00e8s leur journ\u00e9e de travail<\/strong>, mais aussi pendant leurs vacances.\u00a0<strong>Augmentation de la charge de travail et des responsabilit\u00e9s<\/strong>, pression du chiffre, peur de perdre leur travail, nombreux sont les salari\u00e9s tent\u00e9s de r\u00e9pondre aux\u00a0E-mail, aux messages instantan\u00e9s, aux coups de t\u00e9l\u00e9phone et SMS tardifs.\u00a0<\/p>\n<p>Or, selon un sondage OpinionWay r\u00e9alis\u00e9 pour El\u00e9as, 23 % seulement des entreprises ont cr\u00e9\u00e9 une charte de bonne pratique des mails et seulement 16 % ont cr\u00e9\u00e9 des r\u00e8gles de d\u00e9connexion.<\/p>\n<h2>La n\u00e9gociation collective sur le droit \u00e0 la d\u00e9connexion<\/h2>\n<p>Dans les entreprises de 50 salari\u00e9s et plus, l&#8217;employeur doit engager, chaque ann\u00e9e (sauf accord d\u2019entreprise pr\u00e9voyant une p\u00e9riodicit\u00e9 diff\u00e9rente dans la limite de 4 ans), une n\u00e9gociation sur l&#8217;\u00e9galit\u00e9 professionnelle entre les femmes et les hommes, portant notamment sur les mesures visant \u00e0 supprimer les \u00e9carts de r\u00e9mun\u00e9ration, et la <strong>qualit\u00e9 de vie au travail<\/strong>.<\/p>\n<p>Depuis le 1<sup>er<\/sup> janvier 2017, cette n\u00e9gociation doit porter sur les modalit\u00e9s d\u2019exercice du droit \u00e0 la d\u00e9connexion des salari\u00e9s et la mise en place par l\u2019entreprise de dispositifs de r\u00e9gulation de l\u2019utilisation des outils num\u00e9riques, en vue d&#8217;assurer le respect des temps de repos et de cong\u00e9 ainsi que de la vie personnelle et familiale.<\/p>\n<p>A d\u00e9faut d&#8217;accord incluant le droit \u00e0 la d\u00e9connexion, l&#8217;employeur doit \u00e9laborer une charte, apr\u00e8s avis des repr\u00e9sentants du personnel (CSE).<\/p>\n<h2>Les sanctions en l&#8217;absence d&#8217;accord ou de charte sur le droit \u00e0 la d\u00e9connexion<\/h2>\n<p>L\u2019absence de n\u00e9gociations annuelles obligatoires constitue un d\u00e9lit d\u2019entrave. Elle emp\u00eache \u00e9galement l\u2019entreprise de soumissionner \u00e0 un appel d\u2019offre de march\u00e9 public.<\/p>\n<p>En l\u2019absence d\u2019accord ou de proc\u00e8s-verbal de d\u00e9saccord, l\u2019employeur pourra se voir appliquer une p\u00e9nalit\u00e9 financi\u00e8re \u00e9gale \u00e0 1 % maximum de la masse salariale.<\/p>\n<p>Le d\u00e9faut de convocation des <a class=\"abbr\" title=\"D\u00e9l\u00e9gu\u00e9s Syndicaux\" href=\"https:\/\/www.legisocial.fr\/definition-ds-delegues-syndicaux.html\" target=\"_blank\" rel=\"noopener\"><abbr title=\"D\u00e9l\u00e9gu\u00e9s Syndicaux\">DS<\/abbr><\/a> \u00e0 la <a class=\"abbr\" title=\"N\u00e9gociation Annuelle Obligatoire\" href=\"https:\/\/www.legisocial.fr\/definition-nao-negociation-annuelle-obligatoire.html\" target=\"_blank\" rel=\"noopener\"><abbr title=\"N\u00e9gociation Annuelle Obligatoire\">NAO<\/abbr><\/a> et de n\u00e9gociations peut \u00eatre puni d\u2019un emprisonnement d\u20191 an et d\u2019une amende de 3\u00a0750 \u20ac.<\/p>\n<p>En revanche, il n\u2019est pas pr\u00e9vu de p\u00e9nalit\u00e9 en cas d\u2019absence de charte sur le droit \u00e0 la d\u00e9connexion.<\/p>\n<p>Attention toutefois, en l\u2019absence de charte, l\u2019employeur peut se voir condamner pour faute inexcusable en cas de maladie ou d&#8217;accident d&#8217;un salari\u00e9 li\u00e9(e) au non-respect de son droit \u00e0 d\u00e9connexion.<\/p>\n<p>De plus, le non-respect du repos quotidien comme du repos hebdomadaire expose l\u2019employeur \u00e0 sanctions civiles et p\u00e9nales.<\/p>\n<h2><strong>R\u00e9f\u00e9rences<\/strong><\/h2>\n<p>Enqu\u00eate &#8220;<em>L&#8217;impact des outils num\u00e9riques professionnels sur les salari\u00e9s<\/em>&#8220;, Sondage OpinionWay pour El\u00e9as, 2018.<\/p>\n<p>\u00c9tude Qapa, les fran\u00e7ais et les vacances, 8 juillet 2019.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Une \u00e9tude indique que 67 % des fran\u00e7ais ne parviennent pas \u00e0 d\u00e9crocher de leur travail pendant leurs vacances. 89 % des femmes et 85 % des hommes trouvent que le\u00a0travail est bien plus pr\u00e9sent qu&#8217;auparavant pendant leurs vacances.
