en mati\u00e8re de faute inexcusable de l\u2019employeur\u00a0\u00a0"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">La Cour de cassation a statu\u00e9 dans un&nbsp;dossier amiante,&nbsp;mais&nbsp;qui peut \u00eatre \u00e9tendu au dossier de maladies professionnelles.&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Les ayants&nbsp;droit&nbsp;d\u2019un salari\u00e9 d\u00e9c\u00e9d\u00e9 d\u2019un ad\u00e9nocarcinome pulmonaire, reconnu au titre du tableau n\u00b0&nbsp;30 bis, avaient saisi la juridiction en faute inexcusable contre le premier employeur.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depuis un arr\u00eat du 15 juin 2017 (n\u00b016-14.901)&nbsp;c\u2019\u00e9tait&nbsp;\u00e0 l\u2019employeur de prouver qu\u2019il n\u2019avait pas expos\u00e9 le salari\u00e9 aux&nbsp;risques&nbsp;(Cassation&nbsp;2<sup>e<\/sup>&nbsp;civile, 15 juin 2017, n\u00b016-14.901).&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dans son arr\u00eat du 25 juin 2026, la Cour de cassation a estim\u00e9 qu\u2019en application du droit commun de la preuve (article 1353 du Code civil) et du principe d\u2019ind\u00e9pendance des rapports tripartites caisse\/ victime\/employeur, c\u2019est \u00e0 la victime ou \u00e0 ses ayants&nbsp;droit de prouver qu\u2019elle a \u00e9t\u00e9 expos\u00e9e au risque chez l\u2019employeur dont la faute inexcusable est recherch\u00e9e.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ainsi, la d\u00e9cision de prise en charge par la CPAM ne cr\u00e9e aucune pr\u00e9somption \u00e0 cet \u00e9gard.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ce revirement \u00e9tait souhaitable, en effet,&nbsp;imposer \u00e0 l\u2019employeur de prouver une absence d\u2019exposition revenait \u00e0 lui faire supporter la preuve d\u2019un fait n\u00e9gatif, difficilement compatible avec les principes probatoires.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La cons\u00e9quence de ce revirement est que dans les dossiers amiante ou de maladies professionnelles multi-employeurs, les demandeurs devront d\u00e9sormais constituer un dossier probatoire sur la r\u00e9alit\u00e9 de l\u2019exposition durant la p\u00e9riode d\u2019emploi vis\u00e9e\u00a0(Cassation civile, 2<sup>e<\/sup>,\u00a025 juin 2026,\u00a0n\u00b023-22.278,
