production\u00a0d\u2019emails\u00a0peut constituer un \u00e9l\u00e9ment important dans l\u2019administration de la preuve des d\u00e9passements horaires du salari\u00e9.\u00a0\u00a0\u00a0\u00a0\u00a0<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">La Cour de cassation admet qu\u2019il puisse&nbsp;y&nbsp;avoir acc\u00e8s, qu\u2019il puisse solliciter communication de sa messagerie professionnelle&nbsp;(Cassation sociale 24 juin 2026,25-10.397).&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Un salari\u00e9 avait saisi le Conseil de prud\u2019hommes sur le fondement de l\u2019article 145 du&nbsp;Code de proc\u00e9dure civile,&nbsp;afin de solliciter la communication de sa messagerie professionnelle, et ce dans le cadre d\u2019une demande de paiement d\u2019heures suppl\u00e9mentaires.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cet article rappelle dans son premier alin\u00e9a que&nbsp;<em>\u00ab s\u2019il existe un motif l\u00e9gitime de conserver ou d\u2019\u00e9tablir avant tout proc\u00e8s la preuve de fait dont pourrait d\u00e9pendre la solution d\u2019un litige, les mesures d\u2019instruction l\u00e9galement admissibles peuvent \u00eatre ordonn\u00e9es \u00e0 la demande de tout int\u00e9ress\u00e9, sur requ\u00eate ou en r\u00e9f\u00e9r\u00e9\u2026&nbsp;\u00bb.&nbsp;<\/em>&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le salari\u00e9 ayant formul\u00e9 une demande de communication, la Cour d\u2019appel de Paris&nbsp;l\u2019a d\u00e9bout\u00e9 de sa demande, estimant d\u2019une part que le demandeur avait d\u00e9j\u00e0 des \u00e9l\u00e9ments sur ses heures de travail et que, d\u2019autre part, sa demande apparaissait comme trop g\u00e9n\u00e9rale.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La Cour de cassation a, dans son arr\u00eat du 24 juin 2026, cass\u00e9 l\u2019arr\u00eat de la Cour d\u2019appel de Paris.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La Cour a ainsi affirm\u00e9 que l\u2019existence d\u2019un m\u00e9canisme probatoire sp\u00e9cifique en mati\u00e8re de dur\u00e9e du travail, \u00e0 savoir l\u2019am\u00e9nagement de la charge de la preuve, n\u2019exclut pas l\u2019application de l\u2019article 145 du&nbsp;Code de proc\u00e9dure civile.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dans un deuxi\u00e8me temps, la Cour de cassation, poursuivant sa jurisprudence sur la proportionnalit\u00e9, a relev\u00e9 que le droit \u00e0 la preuve peut justifier l\u2019atteinte \u00e0 la vie personnelle, notamment de tiers, d\u00e8s lors que la production sollicit\u00e9e est indispensable \u00e0 l\u2019exercice du droit et proportionn\u00e9e au but recherch\u00e9.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Concernant la protection de la vie personnelle, la Cour pr\u00e9cise&nbsp;\u00e9galement,&nbsp;qu\u2019une&nbsp;partie des documents peut \u00eatre anonymis\u00e9e&nbsp;(Cassation sociale 24 juin 2026, n\u00b025-10.397).&nbsp;<\/p>\n\n\n\n<p
