sur le pr\u00e9judice syst\u00e9matique\u00a0\u00a0\u00a0\u00a0\u00a0"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">La Cour de cassation poursuit son \u0153uvre en mati\u00e8re de pr\u00e9judice syst\u00e9matique selon les termes abord\u00e9s.\u00a0\u00a0\u00a0\u00a0<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Deux&nbsp;arr\u00eats r\u00e9cents viennent&nbsp;apporter des pr\u00e9cisions.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Aux termes d\u2019un arr\u00eat du 17 juin 2026 (Cassation sociale, 17 juin 2026, n\u00b0&nbsp;25-10.517)&nbsp;la Cour de cassation pr\u00e9cise que l\u2019existence d\u2019un pr\u00e9judice et l\u2019\u00e9valuation de celui-ci rel\u00e8vent du pouvoir souverain d\u2019appr\u00e9ciation&nbsp;des juges du fond.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dans cette esp\u00e8ce, la salari\u00e9e n\u2019avait b\u00e9n\u00e9fici\u00e9 que d\u2019une seule formation professionnelle en 28 ann\u00e9es d\u2019emploi&nbsp;et \u00e9tablissait un manquement de l\u2019employeur \u00e0 son obligation de veiller au maintien de sa capacit\u00e9 \u00e0 occuper un emploi et \u00e0 son obligation de formation.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pour autant, celle-ci ne justifiait&nbsp;d\u2019aucun&nbsp;pr\u00e9judice r\u00e9sultant du non-respect par l\u2019employeur de son obligation de formation, la Cour de cassation a approuv\u00e9 la Cour d\u2019appel qui avait d\u00e9cid\u00e9 que la demande de dommages&nbsp;et&nbsp;int\u00e9r\u00eats devait \u00eatre rejet\u00e9e.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pas de pr\u00e9judice syst\u00e9matique.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dans un deuxi\u00e8me arr\u00eat du 24 juin 2026&nbsp;(n\u00b024-22.792) la Cour de cassation rappelle qu\u2019une violation&nbsp;du RGPD \u00e0 elle&nbsp;seule ne suffit pas \u00e0 ouvrir droit \u00e0 r\u00e9paration,&nbsp;ici&nbsp;encore le salari\u00e9 doit d\u00e9montrer l\u2019existence d\u2019un pr\u00e9judice en lien direct avec cette violation.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Les juges du&nbsp;fond avaient admis la recevabilit\u00e9 des preuves apport\u00e9es \u00e0 l\u2019appui de cette violation du RGPD, fournies&nbsp;par le salari\u00e9.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La Cour d\u2019appel de Paris avait condamn\u00e9 l\u2019employeur \u00e0 verser une somme de 5\u202f000&nbsp;\u20ac&nbsp;de dommages et int\u00e9r\u00eats pour ex\u00e9cution d\u00e9loyale du contrat de travail, estimant que la seule violation du RGPD justifiait une r\u00e9paration.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La Cour de cassation en a jug\u00e9 autrement,&nbsp;au visa de l\u2019article 82, paragraphe 1,&nbsp;du RGPD qui pr\u00e9voit que&nbsp;<em>\u00ab toute personne ayant subi un dommage mat\u00e9riel ou moral du fait d\u2019une violation du pr\u00e9sent r\u00e8glement a le droit d\u2019obtenir du responsable du traitement ou du sous-traitant r\u00e9paration du pr\u00e9judice subi \u00bb.<\/em>&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La&nbsp;Cour de cassation&nbsp;exige&nbsp;donc une preuve renforc\u00e9e en ce qui concerne le pr\u00e9judice et \u00e9carte toute notion de pr\u00e9judice syst\u00e9matique.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n","protected":false},"excerpt":{"rendered":"<p>La Cour de cassation poursuit son
