{"id":14324,"date":"2026-07-03T08:28:18","date_gmt":"2026-07-03T08:28:18","guid":{"rendered":"https:\/\/abeille.law\/?p=14324"},"modified":"2026-07-03T08:28:21","modified_gmt":"2026-07-03T08:28:21","slug":"le-salarie-teletravaillant-depuis-letranger-sans-en-informer-lemployeur-commet-il-une-faute-grave","status":"publish","type":"post","link":"https:\/\/abeille.law\/en\/le-salarie-teletravaillant-depuis-letranger-sans-en-informer-lemployeur-commet-il-une-faute-grave\/","title":{"rendered":"Le salari\u00e9 t\u00e9l\u00e9travaillant depuis l\u2019\u00e9tranger\u00a0sans en informer l\u2019employeur commet-il une faute grave\u202f?\u00a0\u00a0\u00a0\u00a0"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">Le salari\u00e9 qui exerce son activit\u00e9 en t\u00e9l\u00e9travail depuis\u00a0l\u2019\u00e9tranger\u00a0sans en avoir pr\u00e9alablement inform\u00e9 son employeur manque \u00e0 ses obligations contractuelles.\u00a0\u00a0<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Par un arr\u00eat en date du&nbsp;22 janvier 2026&nbsp;(n\u00b023\/03562), la Cour d\u2019appel de Versailles a jug\u00e9 que&nbsp;le salari\u00e9 qui exerce son activit\u00e9 en t\u00e9l\u00e9travail depuis l\u2019\u00e9tranger sans en avoir pr\u00e9alablement inform\u00e9 son employeur manque \u00e0 ses obligations contractuelles.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;Toutefois, lorsque ce manquement demeure isol\u00e9 et que le salari\u00e9 est rest\u00e9 disponible pour son employeur, il peut justifier un licenciement pour cause r\u00e9elle et s\u00e9rieuse, sans pour autant caract\u00e9riser une faute grave.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00ab\u202f<em>S&#8217;agissant d&#8217;avoir manqu\u00e9 \u00e0 son obligation contractuelle en mati\u00e8re de t\u00e9l\u00e9travail faute d&#8217;avoir inform\u00e9 son employeur d&#8217;un changement de domicile et des changements de conditions d&#8217;exercice du t\u00e9l\u00e9travail, il ressort du contrat de travail de M. [W] que celui-ci s&#8217;engage \u00e0 faire conna\u00eetre sans d\u00e9lai tout changement de situation le concernant, notamment changement de domicile et que le contrat est notamment r\u00e9gi par l&#8217;accord de performance sign\u00e9 par la direction et les organisations syndicales repr\u00e9sentatives le 17 d\u00e9cembre 2019, lequel pr\u00e9voit que le t\u00e9l\u00e9travail s&#8217;effectue au domicile du salari\u00e9, en sorte qu&#8217;en partant au Pakistan sans en informer son employeur et en t\u00e9l\u00e9travaillant depuis ce pays sans informer son employeur du changement dans les conditions d&#8217;exercice du t\u00e9l\u00e9travail, M. [W] a manqu\u00e9 \u00e0 ses obligations contractuelles sur ce point. Il sera par ailleurs observ\u00e9 que si l&#8217;employeur reproche \u00e9galement \u00e0 son salari\u00e9 de ne pas s&#8217;\u00eatre tenu disponible \u00e0 tout moment afin de maintenir le lien avec l&#8217;entreprise et pouvoir assister aux r\u00e9unions, rendez-vous clients et manifestations collectives o\u00f9 sa pr\u00e9sence physique serait jug\u00e9e n\u00e9cessaire, \u00e9tant amen\u00e9 \u00e0 effectuer des tests sur les outils informatiques qui ne peuvent pas \u00eatre faits \u00e0 distance, force est de constater que le salari\u00e9 avait \u00e9t\u00e9 mis en t\u00e9l\u00e9travail en raison de la p\u00e9riode de confinement li\u00e9e \u00e0 l&#8217;\u00e9pid\u00e9mie de Covid-19, du 1er novembre au 5 d\u00e9cembre 2020 par son employeur, ce que ne conteste pas ce dernier, en sorte que celui-ci ne pouvait reprocher \u00e0 son salari\u00e9, sans se contredire, de ne pouvoir \u00eatre pr\u00e9sent physiquement au sein de l&#8217;association.
