{"id":14201,"date":"2026-05-13T12:50:06","date_gmt":"2026-05-13T12:50:06","guid":{"rendered":"https:\/\/abeille.law\/?p=14201"},"modified":"2026-05-13T12:50:07","modified_gmt":"2026-05-13T12:50:07","slug":"preuve-illicite-en-droit-du-travail-quelles-evolutions-recentes","status":"publish","type":"post","link":"https:\/\/abeille.law\/en\/preuve-illicite-en-droit-du-travail-quelles-evolutions-recentes\/","title":{"rendered":"Actualit\u00e9s en droit de la preuve"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">Quelles nouveaut\u00e9s en mati\u00e8re d\u2019admission de la preuve illicite en droit du travail\u00a0?\u00a0\u00a0\u00a0\u00a0\u00a0<\/h2>\n\n\n\n<p>Depuis le mouvement initi\u00e9 par l\u2019Assembl\u00e9e pl\u00e9ni\u00e8re du 22 d\u00e9cembre 2023, la Cour de cassation tranche de nombreux contentieux relatifs \u00e0 la recevabilit\u00e9 de la preuve illicite, conduisant \u00e0 des \u00e9volutions jurisprudentielles qu\u2019il convient de souligner.\u00a0\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">La recevabilit\u00e9 de la preuve\u00a0obtenue \u00e0 la suite du vol de documents\u00a0contenus\u00a0l\u2019ordinateur du dirigeant (Cass. Soc, 1<sup>er<\/sup>\u00a0avril 2026, n\u00b024-19.193)\u202f<\/h2>\n\n\n\n<p>Dans cet arr\u00eat, la Cour de cassation s\u2019est prononc\u00e9e sur la question de savoir&nbsp;si&nbsp;la production de&nbsp;documents&nbsp;vol\u00e9s par le salari\u00e9&nbsp;sur l\u2019ordinateur de l\u2019employeur&nbsp;durant sa&nbsp;mise&nbsp;\u00e0 pied \u00e0 titre conservatoire&nbsp;peut \u00eatre&nbsp;justifi\u00e9e&nbsp;par le droit \u00e0 la preuve et de fait \u00eatre consid\u00e9r\u00e9e&nbsp;comme recevable devant le juge.&nbsp;&nbsp;<\/p>\n\n\n\n<p>La&nbsp;Cour de cassation valide l&#8217;admission aux d\u00e9bats de documents obtenus par un salari\u00e9 en acc\u00e9dant sans autorisation au syst\u00e8me informatique de l&#8217;entreprise durant sa mise \u00e0 pied conservatoire.&nbsp;<\/p>\n\n\n\n<p>En effet, la Cour apr\u00e8s analyse des crit\u00e8res classiques, \u00e0 savoir le caract\u00e8re indispensable et la proportionnalit\u00e9 de l\u2019atteinte aux libert\u00e9s en balance a jug\u00e9 que&nbsp;le salari\u00e9 ne pouvait pas atteindre un r\u00e9sultat&nbsp;identique&nbsp;en utilisant d\u2019autres moyens plus respectueux de la vie personnel du dirigeant de sorte que pour la Cour, l\u2019absence de voie probatoire alternative moins attentatoire aux droits en pr\u00e9sence,&nbsp;la preuve d\u00e9rob\u00e9e par le salari\u00e9 sur l\u2019ordinateur du dirigeant doit \u00eatre consid\u00e9r\u00e9 comme recevable.&nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Sur l\u2019irrecevabilit\u00e9 des documents couverts par le secret m\u00e9dical\u00a0(Cass. Soc, 1<sup>er<\/sup>\u00a0avril 2026, n\u00b024-21.452 et 24-21.453)\u00a0\u00a0<\/h2>\n\n\n\n<p>Dans cet arr\u00eat, la&nbsp;chambre sociale de la Cour de cassation s\u2019est prononc\u00e9e sur la question de savoir si&nbsp;la production de documents&nbsp;couverts par le secret m\u00e9dical pouvait \u00eatre&nbsp;consid\u00e9r\u00e9s comme recevable devant le juge.&nbsp;<\/p>\n\n\n\n<p>Pour la Cour de cassation,&nbsp;la production des extraits du journal infirmier \u00e9tait\u202f\u00e0 la fois indispensable et proportionn\u00e9e. Les salari\u00e9s avaient pris soin de biffer les noms des r\u00e9sidents, le document ne mentionnait pas le nom de l&#8217;\u00e9tablissement et ne permettait pas en lui-m\u00eame l&#8217;identification des patients par leur seul num\u00e9ro de chambre, tandis que l&#8217;indication de ce num\u00e9ro permettait de comprendre qu&#8217;il s&#8217;agissait de patients diff\u00e9rents.&nbsp;<\/p>\n\n\n\n<p>Ainsi,&nbsp;ces arr\u00eats confirment que le droit \u00e0 la preuve peut l\u00e9gitimement justifier la production d&#8217;un document couvert par le secret m\u00e9dical, \u00e0 condition que cette production soit\u202fcumulativement\u202findispensable et proportionn\u00e9e.\u202f&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Quelles
