{"id":14197,"date":"2026-05-13T12:30:36","date_gmt":"2026-05-13T12:30:36","guid":{"rendered":"https:\/\/abeille.law\/?p=14197"},"modified":"2026-05-13T12:30:37","modified_gmt":"2026-05-13T12:30:37","slug":"droit-a-la-deconnexion-pendant-un-arret-maladie-la-spontaneite-du-salarie-fait-echec-au-manquement-de-lemployeur","status":"publish","type":"post","link":"https:\/\/abeille.law\/en\/droit-a-la-deconnexion-pendant-un-arret-maladie-la-spontaneite-du-salarie-fait-echec-au-manquement-de-lemployeur\/","title":{"rendered":"Droit \u00e0 la d\u00e9connexion pendant un arr\u00eat maladie : la spontan\u00e9it\u00e9\u00a0du salari\u00e9\u00a0fait \u00e9chec au manquement de l&#8217;employeur"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">Par un arr\u00eat en date du 25 mars 2026 (n\u00b024-21.098), la chambre sociale de la Cour de cassation s\u2019est prononc\u00e9e sur\u00a0la\u202ffronti\u00e8re entre le manquement de l&#8217;employeur \u00e0 l&#8217;obligation d&#8217;assurer le droit \u00e0 la d\u00e9connexion d&#8217;un salari\u00e9 en arr\u00eat maladie et l&#8217;initiative propre du salari\u00e9\u202fqui se connecte et travaille de son plein gr\u00e9\u00a0\u00a0\u00a0<\/h2>\n\n\n\n<p>Ainsi,\u202fla chambre sociale introduit une\u202fdistinction fondamentale\u202f:&nbsp;&nbsp;<\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li>La jurisprudence protectrice\u00a0en vertu d\u2019un\u00a0manquement constat\u00e9\u00a0le salari\u00e9 peut pr\u00e9tendre \u00e0 une r\u00e9paration\u00a0ne s&#8217;applique que lorsque l&#8217;employeur\u202fimpose\u202fau salari\u00e9 de travailler, directement ou indirectement (par relances, par sollicitations actives, par l&#8217;organisation m\u00eame du travail).\u00a0\u00a0<\/li>\n<\/ol>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li>Lorsque le salari\u00e9, en l&#8217;absence de toute pression caract\u00e9ris\u00e9e, choisit librement et spontan\u00e9ment de se connecter et d&#8217;agir, ce comportement autonome rompt le lien de causalit\u00e9 entre l&#8217;absence de dispositif de d\u00e9connexion et le pr\u00e9judice all\u00e9gu\u00e9.\u00a0<\/li>\n<\/ol>\n\n\n\n<p>La chambre sociale affirme que le droit \u00e0 la d\u00e9connexion pendant un arr\u00eat maladie n&#8217;est pas un m\u00e9canisme de responsabilit\u00e9 objective de l&#8217;employeur&nbsp;d\u00e8s lors que&nbsp;le comportement spontan\u00e9 et autonome du salari\u00e9 peut suffire \u00e0 \u00e9carter le manquement.\u202f&nbsp;<\/p>\n\n\n\n<p>Si l\u2019arr\u00eat du 25 mars 2026 concerne le salari\u00e9 plac\u00e9 en arr\u00eat maladie, en revanche, il appara\u00eet que celui-ci est tout \u00e0 fait transposable en mati\u00e8re de contentieux relatifs aux heures suppl\u00e9mentaires.&nbsp;&nbsp;<\/p>\n\n\n\n<p>\u00ab\u202f<em>L\u2019arr\u00eat, qui a constat\u00e9 qu\u2019aucun \u00e9l\u00e9ment ne venait d\u00e9montrer une obligation du salari\u00e9 de traiter imm\u00e9diatement les courriels re\u00e7us, d\u00e8s lors qu\u2019ils constituaient pour la plupart des notifications automatiques, le salari\u00e9 ayant fait le choix de r\u00e9pondre en se connectant spontan\u00e9ment \u00e0 son poste informatique professionnel pour ce faire et en r\u00e9alisant des actions ponctuelles, n\u2019encourt pas les griefs du moyen<\/em>\u202f\u00bb (<strong><em>Cass.
