Elle \u00e9nonce, dans un consid\u00e9rant de principe, que d\u00e8s lors que l\u2019administration a connaissance d\u2019un risque pour la sant\u00e9 physique et morale d\u2019un agent, il lui appartient de prendre, dans un d\u00e9lai raisonnable, les mesures adapt\u00e9es qui sont en son pouvoir pour pr\u00e9venir ou faire cesser une situation de burnout.\u00a0<\/p>\n\n\n\n<p>L\u2019int\u00e9r\u00eat de l\u2019arr\u00eat tient d\u2019abord \u00e0 ce qu\u2019il distingue clairement ce terrain contentieux de celui du&nbsp;<strong>harc\u00e8lement moral<\/strong>. L\u2019absence de harc\u00e8lement n\u2019exclut pas, en effet, un manquement de l\u2019administration \u00e0 son obligation de s\u00e9curit\u00e9, laquelle rel\u00e8ve du droit commun de la responsabilit\u00e9 pour faute.&nbsp;<\/p>\n\n\n\n<p>La cour rappelle que cette obligation trouve son fondement dans le CGFP, combin\u00e9 aux r\u00e8gles du Code du travail relatives \u00e0 la protection de la sant\u00e9 physique et mentale des travailleurs. Elle s\u2019analyse comme une&nbsp;<strong>obligation de pr\u00e9vention et de r\u00e9action<\/strong>, adapt\u00e9e aux contraintes du service public et aux moyens effectivement allou\u00e9s \u00e0 l\u2019administration.&nbsp;<\/p>\n\n\n\n<p>L\u2019arr\u00eat met aussi en lumi\u00e8re les crit\u00e8res du contr\u00f4le du juge. Celui-ci semble s\u2019organiser autour de trois questions : la r\u00e9alit\u00e9 et l\u2019intensit\u00e9 de la surcharge de travail, ses effets sur l\u2019\u00e9tat de sant\u00e9 de l\u2019agent, puis les mesures prises par l\u2019administration pour y rem\u00e9dier.&nbsp;<\/p>\n\n\n\n<p>En l\u2019esp\u00e8ce, malgr\u00e9 la reconnaissance m\u00e9dicale d\u2019un burnout invoqu\u00e9 par un major de police, la cour n\u2019a pas retenu l\u2019existence d\u2019une surcharge de travail excessive de nature \u00e0 engager la responsabilit\u00e9 de l\u2019\u00c9tat. Elle rel\u00e8ve notamment qu\u2019une moyenne de 5 \u00e0 6&nbsp;heures suppl\u00e9mentaires hebdomadaires sur un peu moins de deux ans ne suffisait pas, dans le contexte consid\u00e9r\u00e9, \u00e0 caract\u00e9riser un tel manquement.&nbsp;<\/p>\n\n\n\n<p>L\u2019arr\u00eat n\u2019en demeure pas moins important : il confirme que&nbsp;<strong>l\u2019employeur public ne peut rester inactif<\/strong>&nbsp;lorsqu\u2019un risque psychosocial est signal\u00e9 et qu\u2019il lui revient de justifier, le cas \u00e9ch\u00e9ant, des mesures concr\u00e8tes prises pour prot\u00e9ger la sant\u00e9 de ses agents.&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>CAA Paris, 5\u202fmars 2025, n\u00b0 23PA00370, C\u202f+&nbsp;&nbsp; Par un arr\u00eat du 5 mars 2025, la CAA de Paris pr\u00e9cise le r\u00e9gime du manquement \u00e0 l\u2019obligation de s\u00e9curit\u00e9 de l\u2019employeur public en cas de risque d\u2019\u00e9puisement professionnel.
