Il ne peut imposer un tel changement unilat\u00e9ralement, m\u00eame en invoquant son pouvoir de direction<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Par un arr\u00eat&nbsp;en date du&nbsp;4 f\u00e9vrier 2026&nbsp;(n\u00b024-17.033), la Chambre sociale de la Cour de cassation a rappel\u00e9&nbsp;que&nbsp;lorsque la nouvelle r\u00e9partition des horaires a pour effet de priver le salari\u00e9 de son repos dominical, il ne s\u2019agit pas d\u2019un simple changement des conditions de travail, mais d\u2019une\u202fmodification du contrat de travail\u202fn\u00e9cessitant l\u2019accord expr\u00e8s du salari\u00e9\u202f:&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00ab\u202f<em>Pour d\u00e9bouter le salari\u00e9 de sa contestation du bien-fond\u00e9 du licenciement, l&#8217;arr\u00eat rel\u00e8ve que le dernier avenant au contrat de travail pr\u00e9voyait une fin de service au plus tard \u00e0 16 heures les lundi, mardi et jeudi et \u00e0 10 heures les mercredi, vendredi et samedi et que, le 28 f\u00e9vrier 2017 l&#8217;employeur l&#8217;avait inform\u00e9 de ses nouveaux horaires le lundi de 13 heures \u00e0 16 heures et de 17 heures \u00e0 20 heures 30, du mardi au jeudi de 12 heures 30 \u00e0 16 heures et de 17 heures \u00e0 20 heures 30 et le dimanche de 6 heures \u00e0 13 heures 30.<\/em>&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Il retient que le salari\u00e9 a refus\u00e9 d&#8217;appliquer les nouveaux horaires sans pour autant d\u00e9montrer que le changement d&#8217;horaires&nbsp;avait pour lui des cons\u00e9quences excessives, notamment sur sa vie priv\u00e9e ou encore qu&#8217;il&nbsp;\u00e9tait&nbsp;incompatible avec des obligations familiales imp\u00e9rieuses, que ce manquement du salari\u00e9 constitue une faute grave qui emp\u00eache la poursuite du contrat de travail.<\/em>&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>En statuant ainsi, alors qu&#8217;elle avait constat\u00e9 que la nouvelle r\u00e9partition de l&#8217;horaire de travail avait pour effet de priver le salari\u00e9 du repos dominical, ce qui constituait une modification de son contrat de travail ne pouvant lui \u00eatre impos\u00e9e sans son accord expr\u00e8s, la cour d&#8217;appel a viol\u00e9 les textes susvis\u00e9s<\/em>\u202f\u00bb.&nbsp;(<em>Cass Soc,&nbsp;4 f\u00e9vrier 2026, n\u00b024-17.033<\/em>).&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n","protected":false},"excerpt":{"rendered":"<p>D\u00e8s lors que les nouveaux horaires ont pour effet de supprimer le repos dominical dont b\u00e9n\u00e9ficiait le salari\u00e9, l\u2019employeur touche \u00e0 un \u00e9l\u00e9ment contractuel.
