{"id":13959,"date":"2026-02-13T15:55:48","date_gmt":"2026-02-13T15:55:48","guid":{"rendered":"https:\/\/abeille.law\/?p=13959"},"modified":"2026-04-20T16:09:52","modified_gmt":"2026-04-20T16:09:52","slug":"indemnite-deviction-et-delais-ce-que-rappelle-la-cour-de-cassation","status":"publish","type":"post","link":"https:\/\/abeille.law\/en\/indemnite-deviction-et-delais-ce-que-rappelle-la-cour-de-cassation\/","title":{"rendered":"Indemnit\u00e9 d\u2019\u00e9viction\u00a0et d\u00e9lais\u00a0: ce que rappelle la Cour de cassation\u00a0"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\"><strong>Dans une d\u00e9cision du 12 f\u00e9vrier 2026 (Cass. 3e civ., 12 f\u00e9vr. 2026, n\u00b0 24-10.578), la Cour de cassation pr\u00e9cise les contours des cons\u00e9quences de l&#8217;inertie\u00a0du locataire lorsqu\u2019un cong\u00e9 sans renouvellement lui est d\u00e9livr\u00e9.\u00a0\u00a0<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><br><\/strong>Le d\u00e9lai pour saisir le tribunal court d\u00e8s la date pour laquelle le cong\u00e9 est donn\u00e9, conform\u00e9ment \u00e0 l\u2019article L. 1459 du Code de commerce.\u00a0\u00a0Et la mauvaise foi reproch\u00e9e au bailleur n\u2019a aucun effet sur cette prescription biennale pr\u00e9vue par l\u2019article L. 14560 du m\u00eame code.\u00a0\u00a0<br>Pour\u00a0la Cour,\u00a0une fois ce d\u00e9lai expir\u00e9, le\u00a0droit au\u00a0maintien dans les lieux cesse de plein droit,\u00a0de sorte que\u00a0l\u2019occupation devient\u00a0t un trouble manifestement illicite au sens de l\u2019article 835, alin\u00e9a 1er, du Code de proc\u00e9dure civile.\u00a010.578), la Cour de cassation pr\u00e9cise les contours de l\u2019action du locataire lorsqu\u2019un cong\u00e9 sans renouvellement lui est d\u00e9livr\u00e9.\u00a09 du Code de commerce.\u00a060 du m\u00eame code.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Un d\u00e9lai l\u00e9gal strict pour demander l\u2019indemnit\u00e9 d\u2019\u00e9viction<\/strong>\u00a0<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Selon l\u2019article L. 145-9 du Code de commerce, le cong\u00e9 donn\u00e9 par le bailleur met fin au bail \u00e0 la date qu\u2019il fixe. La d\u00e9cision du 12 f\u00e9vrier 2026 rappelle qu\u2019\u00e0 compter de cette m\u00eame date commence \u00e0 courir le d\u00e9lai dont dispose le locataire pour saisir le tribunal afin d\u2019obtenir l\u2019indemnit\u00e9 d\u2019\u00e9viction.&nbsp;&nbsp;<br>Ce d\u00e9lai, d\u2019une dur\u00e9e l\u00e9gale d\u00e9termin\u00e9e, reste identique m\u00eame si le cong\u00e9 comporte une offre d\u2019indemnisation ou s\u2019il existe des \u00e9changes sur l\u2019\u00e9valuation de cette indemnit\u00e9. Les discussions amiables ou les h\u00e9sitations du locataire ne reportent pas le point de d\u00e9part de la prescription.&nbsp;9 du Code de commerce, le cong\u00e9 donn\u00e9 par le bailleur met fin au bail \u00e0 la date qu\u2019il fixe. La d\u00e9cision du 12 f\u00e9vrier 2026 rappelle qu\u2019\u00e0 compter de cette m\u00eame date commence \u00e0 courir le d\u00e9lai dont dispose le locataire pour saisir le tribunal afin d\u2019obtenir l\u2019indemnit\u00e9 d\u2019\u00e9viction.&nbsp;&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>La mauvaise foi du bailleur : un argument sans effet sur la prescription<\/strong>&nbsp;<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">L\u2019arr\u00eat retient \u00e9galement que l\u2019attitude du bailleur, m\u00eame per\u00e7ue comme contradictoire ou de mauvaise foi, ne suspend ni n\u2019interrompt la prescription biennale pr\u00e9vue \u00e0 l\u2019article L. 14560 du Code de commerce.&nbsp;&nbsp;<br>La Cour de cassation sanctionne ainsi l\u2019id\u00e9e selon laquelle un comportement implicitement trompeur pourrait&nbsp;suspendre ou interrompre&nbsp;le&nbsp;d\u00e9lai. Seules les causes pr\u00e9vues par la loi ou reconnues comme telles peuvent avoir un effet sur la prescription. Ce n\u2019est donc pas le cas des \u00e9changes pr\u00e9alables ou des n\u00e9gociations qui entourent l\u2019indemnit\u00e9 d\u2019\u00e9viction.&nbsp;60 du Code de commerce.&nbsp;&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Cons\u00e9quence de l&#8217;inertie&nbsp;: pertes&nbsp;de l&#8217;indemnit\u00e9 et du&nbsp;droit au maintien<\/strong>&nbsp;<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Une fois le d\u00e9lai expir\u00e9, le locataire ne peut plus obtenir l\u2019indemnit\u00e9 d\u2019\u00e9viction&nbsp;;&nbsp;il&nbsp;&nbsp;perd&nbsp;automatiquement son droit au maintien dans les lieux, en application de l\u2019article L. 145-28 du Code de commerce.&nbsp;&nbsp;<br>D\u00e8s lors,&nbsp;l\u2019occupation devient \u00ab sans droit ni titre \u00bb.&nbsp;L\u2019apport de l\u2019arr\u00eat est de pr\u00e9ciser que&nbsp;cette&nbsp;situation constitue un trouble manifestement illicite, permettant au bailleur de saisir le juge des r\u00e9f\u00e9r\u00e9s sur le fondement de l\u2019article 835, alin\u00e9a 1er, du Code de proc\u00e9dure civile pour obtenir la restitution des locaux.&nbsp;28 du Code de commerce.&nbsp;&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Les enseignements pratiques pour les&nbsp;locataires commerciaux<\/strong>&nbsp;<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Pour les&nbsp;locataires, plusieurs points doivent \u00eatre retenus :&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>La date inscrite dans le cong\u00e9 est essentielle<\/strong>\u00a0: elle fixe la fin du bail et d\u00e9clenche le d\u00e9lai de l\u2019action \u00e9ventuelle du locataire.\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Les \u00e9changes amiables n\u2019ont aucune incidence sur la prescription<\/strong>\u00a0: seule une saisine du tribunal par le locataire peut emp\u00eacher la d\u00e9ch\u00e9ance de son droit.\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Une fois la prescription acquise<\/strong>, la voie du r\u00e9f\u00e9r\u00e9 peut \u00eatre utilis\u00e9e\u00a0par le bailleur\u00a0pour obtenir l\u2019expulsion du preneur\u00a0devenu\u00a0occupant sans droit.\u00a0<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Le locataire commercial a donc tout int\u00e9r\u00eat \u00e0 ne pas attendre sans agir la fixation du quantum de&nbsp;l\u2019indemnit\u00e9&nbsp; ;&nbsp;il lui incombe de faire consacrer son droit au paiement de l\u2019indemnit\u00e9 avant l\u2019expiration du d\u00e9lai biennal. \u00c0 d\u00e9faut, la sanction est double : perte du droit \u00e0 l\u2019indemnit\u00e9 et perte du droit au maintien dans les
