{"id":13633,"date":"2025-10-17T09:26:59","date_gmt":"2025-10-17T09:26:59","guid":{"rendered":"https:\/\/abeille.law\/?p=13633"},"modified":"2026-01-21T17:33:47","modified_gmt":"2026-01-21T17:33:47","slug":"des-salaries-ayant-commis-la-meme-faute-peuvent-ils-etre-sanctionnes-differemment","status":"publish","type":"post","link":"https:\/\/abeille.law\/en\/des-salaries-ayant-commis-la-meme-faute-peuvent-ils-etre-sanctionnes-differemment\/","title":{"rendered":"Des salari\u00e9s ayant commis la m\u00eame faute peuvent-ils \u00eatre sanctionn\u00e9s diff\u00e9remment ?"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">Il est permis \u00e0 l\u2019employeur, dans l\u2019int\u00e9r\u00eat de l\u2019entreprise et dans l\u2019exercice de son pouvoir d&#8217;individualisation des mesures disciplinaires, de sanctionner diff\u00e9remment des salari\u00e9s qui ont particip\u00e9 \u00e0 une m\u00eame faute.<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Par un arr\u00eat en date du 17 septembre 2025 (n\u00b023-22.456), la Chambre sociale de la Cour de cassation a rappel\u00e9 le principe selon lequel l\u2019employeur peut sanctionner diff\u00e9remment les salari\u00e9s ayant particip\u00e9 aux m\u00eames faits fautifs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En effet, l\u2019application de sanctions diff\u00e9rentes ne constitue pas en soi une discrimination d\u00e8s lors que l\u2019employeur justifie cette diff\u00e9rence de traitement par des \u00e9l\u00e9ments objectifs dont l\u2019appr\u00e9ciation rel\u00e8ve des juges du fond.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00ab&nbsp;<em>Il est permis \u00e0 l&#8217;employeur, dans l&#8217;int\u00e9r\u00eat de l&#8217;entreprise et dans l&#8217;exercice de son pouvoir d&#8217;individualisation des mesures disciplinaires, de sanctionner diff\u00e9remment des salari\u00e9s qui ont particip\u00e9 \u00e0 une m\u00eame faute. Le fait de sanctionner diff\u00e9remment des salari\u00e9s ne constitue pas en soi une discrimination au sens de la loi.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>La cour d&#8217;appel a constat\u00e9, \u00e0 propos des deux autres salari\u00e9es auxquelles l&#8217;int\u00e9ress\u00e9e se comparait, pour Mme [E], qui avait \u00e9galement \u00e9t\u00e9 licenci\u00e9e pour faute grave en raison du caract\u00e8re tardif de sa r\u00e9v\u00e9lation \u00e0 sa hi\u00e9rarchie, en mars 2020, de suspicions d&#8217;abus sexuels sur mineurs connus par elle depuis d\u00e9cembre 2018, qu&#8217;elle avait suivi cette famille durant toute la p\u00e9riode et, pour Mme [R], qui avait fait l&#8217;objet d&#8217;un avertissement pour la m\u00eame faute, qu&#8217;elle n&#8217;avait suivi cette famille que jusqu&#8217;au mois de septembre 2019 et n&#8217;avait pas \u00e9t\u00e9 inform\u00e9e de l&#8217;existence de nouveaux \u00e9l\u00e9ments alarmants en janvier et f\u00e9vrier 2020.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Elle a retenu, par une appr\u00e9ciation souveraine des \u00e9l\u00e9ments de fait et de preuve qui lui \u00e9taient soumis, que l&#8217;individualisation des sanctions disciplinaires \u00e9tait justifi\u00e9e par des \u00e9l\u00e9ments objectifs \u00e9trangers \u00e0 toute discrimination ou d\u00e9tournement de pouvoir<\/em>&nbsp;\u00bb (<strong><em>Cass.
