{"id":13427,"date":"2025-07-19T12:09:54","date_gmt":"2025-07-19T12:09:54","guid":{"rendered":"https:\/\/abeille.law\/?p=13427"},"modified":"2026-01-21T16:32:33","modified_gmt":"2026-01-21T16:32:33","slug":"quid-de-la-validite-de-la-rupture-conventionnelle-du-salarie-protege-qui-se-prevaut-dun-harcelement-moral-aupres-de-son-employeur","status":"publish","type":"post","link":"https:\/\/abeille.law\/en\/quid-de-la-validite-de-la-rupture-conventionnelle-du-salarie-protege-qui-se-prevaut-dun-harcelement-moral-aupres-de-son-employeur\/","title":{"rendered":"Quid de la validit\u00e9 de la rupture conventionnelle du salari\u00e9 prot\u00e9g\u00e9 qui se pr\u00e9vaut d\u2019un harc\u00e8lement moral aupr\u00e8s de son employeur ?"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">Dans un arr\u00eat du 16 mai 2025 (n\u00b0 493143), le Conseil d\u2019\u00c9tat est venu rappeler les principes applicables en mati\u00e8re de rupture conventionnelle concernant un salari\u00e9 prot\u00e9g\u00e9 se pr\u00e9valant d\u2019un harc\u00e8lement moral, pr\u00e9cisant \u00e0 la fois la comp\u00e9tence du juge administratif en cas de contentieux, et les crit\u00e8res d\u2019appr\u00e9ciation du vice du consentement.<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong><u><strong><u>Sur la comp\u00e9tence du juge administratif<\/u><\/strong><\/u><\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Lorsque le salari\u00e9 concern\u00e9 par une rupture conventionnelle b\u00e9n\u00e9ficie d\u2019un statut protecteur, notamment en raison d\u2019un mandat de repr\u00e9sentation du personnel, l\u2019accord de l\u2019inspection du travail est requis pour valider la rupture. En cas de contestation sur la l\u00e9galit\u00e9 de cette autorisation administrative, il appartient au juge administratif, et non au conseil de prud\u2019hommes, d\u2019en appr\u00e9cier la r\u00e9gularit\u00e9, conform\u00e9ment \u00e0 une jurisprudence constante.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En l&#8217;esp\u00e8ce, apr\u00e8s la conclusion d\u2019une rupture conventionnelle entre le salari\u00e9 et l\u2019employeur, d\u00fbment autoris\u00e9e par l&#8217;inspection du travail, le salari\u00e9 a engag\u00e9 une action indemnitaire devant le conseil de prud\u2019hommes. Ce dernier a ainsi saisi, \u00e0 titre pr\u00e9judiciel, le tribunal administratif, afin de se prononcer sur la l\u00e9galit\u00e9 de l\u2019autorisation administrative et la validit\u00e9 de la rupture conventionnelle.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le Conseil d\u2019\u00c9tat confirme ici la comp\u00e9tence du juge administratif pour examiner plusieurs \u00e9l\u00e9ments d\u00e9cisifs :<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>L\u2019existence d\u2019un vice du consentement affectant la volont\u00e9 du salari\u00e9\u00a0;<\/li>\n\n\n\n<li>La r\u00e9gularit\u00e9 de la proc\u00e9dure interne (consultation du comit\u00e9 social et \u00e9conomique, assistance lors des entretiens) ;<\/li>\n\n\n\n<li>L\u2019absence de lien de causalit\u00e9 entre la rupture et l\u2019exercice d\u2019un mandat repr\u00e9sentatif.<\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong><u>Sur la validit\u00e9 de la rupture conventionnelle dans un contexte de harc\u00e8lement moral<\/u><\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Dans son arr\u00eat en date du 16 mai 2025 (n\u00b0493143), le Conseil d\u2019\u00c9tat infirme l\u2019analyse retenue par le tribunal administratif, lequel avait annul\u00e9 la d\u00e9cision de l\u2019inspection du travail au motif que le consentement du salari\u00e9 avait \u00e9t\u00e9 vici\u00e9 en raison de faits de harc\u00e8lement moral.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Or, apr\u00e8s un examen des circonstances li\u00e9es au harc\u00e8lement moral, invoqu\u00e9es par le salari\u00e9, le Conseil d\u2019\u00c9tat consid\u00e8re que ces faits ne sont pas en eux-m\u00eames suffisants pour \u00e9tablir un vice du consentement, sauf s\u2019ils ont directement alt\u00e9r\u00e9 la volont\u00e9 du salari\u00e9 au moment de la signature.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Plusieurs \u00e9l\u00e9ments ont conduit \u00e0 \u00e9carter l\u2019existence d\u2019un vice du consentement :<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Le salari\u00e9 \u00e9tait \u00e0 l\u2019origine de la demande de rupture conventionnelle ;<\/li>\n\n\n\n<li>Il \u00e9tait accompagn\u00e9 par un avocat dans le cadre de la conclusion de la rupture conventionnelle et avait consult\u00e9 le m\u00e9decin du travail \u00e0 plusieurs reprises ;<\/li>\n\n\n\n<li>La convention a \u00e9t\u00e9 sign\u00e9e apr\u00e8s deux entretiens espac\u00e9s, ce qui garantissait un temps de r\u00e9flexion suffisant.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Dans un arr\u00eat du 16 mai 2025 (n\u00b0 493143), le Conseil d\u2019\u00c9tat est venu rappeler les principes applicables en mati\u00e8re de rupture conventionnelle concernant un salari\u00e9 prot\u00e9g\u00e9 se pr\u00e9valant d\u2019un harc\u00e8lement moral, pr\u00e9cisant \u00e0 la fois la comp\u00e9tence du juge administratif en cas de contentieux, et les crit\u00e8res d\u2019appr\u00e9ciation du vice du consentement.
