[X] produit une main courante d\u00e9pos\u00e9e le 24 septembre 2020, soit apr\u00e8s la rupture du contrat de travail, le salari\u00e9 expliquant express\u00e9ment accomplir des d\u00e9marches pour constituer un dossier prud&#8217;homal. Le contenu de la main courante sur une attitude d\u00e9plac\u00e9e de l&#8217;employeur \u00e0 son endroit ne fait que relater ses propos sans \u00eatre assorti du moindre \u00e9l\u00e9ment extrins\u00e8que. Les faits ne peuvent ainsi \u00eatre consid\u00e9r\u00e9s comme mat\u00e9riellement \u00e9tablis. M. [X] produit \u00e9galement l&#8217;attestation de Mme [B] faisant \u00e9tat de petites claques derri\u00e8re la t\u00eate concernant une autre salari\u00e9e mais ne mentionnant \u00e0 aucun moment M. [X].<\/em><\/p>\n<\/blockquote>\n\n\n\n<p>Ces \u00e9l\u00e9ments pris dans leur ensemble sont tr\u00e8s insuffisants pour laisser supposer l&#8217;existence d&#8217;un harc\u00e8lement moral &#8221; (CA Toulouse, 31 janvier 2025, n\u00b023\/01937).<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Insuffisance d&#8217;une attestation du m\u00e9decin du travail (CA Toulouse, 6 f\u00e9vrier 2025, n\u00b023\/01479).<\/strong><\/li>\n<\/ul>\n\n\n\n<p>La Cour d&#8217;appel de Toulouse a jug\u00e9 que l&#8217;attestation du m\u00e9decin du travail, laquelle faisait \u00e9tat des dol\u00e9ances du salari\u00e9 s&#8217;agissant du pr\u00e9tendu comportement de l&#8217;employeur \u00e9tait insufflant a d\u00e9montrer l&#8217;existence d&#8217;une situation de harc\u00e8lement.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>&#8221; En l&#8217;esp\u00e8ce, Mme [E] qui ne vise aucune pi\u00e8ce dans ses \u00e9critures invoque le comportement col\u00e9rique de M. [M] qui l&#8217;aurait rabaiss\u00e9e devant ses coll\u00e8gues. Elle produit uniquement un courrier du m\u00e9decin du travail faisant \u00e9tat de ses dol\u00e9ances quant au comportement de l&#8217;employeur. Alors qu&#8217;aucune date ou circonstance pr\u00e9cise n&#8217;est vis\u00e9e, qu&#8217;aucune pi\u00e8ce autre que relatant les dol\u00e9ances de la salari\u00e9e n&#8217;est vers\u00e9e aux d\u00e9bats, les faits ne peuvent \u00eatre consid\u00e9r\u00e9s comme mat\u00e9riellement \u00e9tablis de sorte qu&#8217;il n&#8217;est pas justifi\u00e9 de faits, qui pris dans leur ensemble, pourraient laisser supposer un harc\u00e8lement moral&#8221; (CA Toulouse, 6 f\u00e9vrier 2025, n\u00b023\/01479)<\/em><\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>La Cour de cassation a r\u00e9cemment apport\u00e9 plusieurs pr\u00e9cisions s&#8217;agissant de la preuve en mati\u00e8re de harc\u00e8lement, et plus pr\u00e9cis\u00e9ment de la force probante des documents relatant les seuls propos du salari\u00e9.
