{"id":13049,"date":"2025-02-14T08:51:53","date_gmt":"2025-02-14T08:51:53","guid":{"rendered":"https:\/\/abeille.law\/?p=13049"},"modified":"2025-02-17T09:53:36","modified_gmt":"2025-02-17T09:53:36","slug":"lorsque-le-salarie-informe-lemployeur-de-son-invalidite-de-categorie-ii-lemployeur-est-il-tenu-dorganiser-une-visite-de-reprise","status":"publish","type":"post","link":"https:\/\/abeille.law\/en\/lorsque-le-salarie-informe-lemployeur-de-son-invalidite-de-categorie-ii-lemployeur-est-il-tenu-dorganiser-une-visite-de-reprise\/","title":{"rendered":"Lorsque le salari\u00e9 informe l&#8217;employeur de son invalidit\u00e9 de cat\u00e9gorie II, l&#8217;employeur est-il tenu d&#8217;organiser une visite de reprise ?"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">D\u00e8s lors que le salari\u00e9 informe son employeur de son invalidit\u00e9 cat\u00e9gorie II sans manifester sa volont\u00e9 de reprendre le travail, l&#8217;employeur est tenu d&#8217;organiser une visite de reprise.<\/h2>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-large is-resized\"><img loading=\"lazy\" decoding=\"async\" width=\"2560\" height=\"1439\" src=\"https:\/\/abeille.law\/wp-content\/uploads\/2025\/02\/AdobeStock_473725876-edited-scaled.jpeg\" alt=\"\" class=\"wp-image-13052\" style=\"width:608px;height:auto\" srcset=\"https:\/\/abeille.law\/wp-content\/uploads\/2025\/02\/AdobeStock_473725876-edited-scaled.jpeg 2560w, https:\/\/abeille.law\/wp-content\/uploads\/2025\/02\/AdobeStock_473725876-edited-300x169.jpeg 300w, https:\/\/abeille.law\/wp-content\/uploads\/2025\/02\/AdobeStock_473725876-edited-1024x576.jpeg 1024w, https:\/\/abeille.law\/wp-content\/uploads\/2025\/02\/AdobeStock_473725876-edited-768x432.jpeg 768w, https:\/\/abeille.law\/wp-content\/uploads\/2025\/02\/AdobeStock_473725876-edited-1536x864.jpeg 1536w, https:\/\/abeille.law\/wp-content\/uploads\/2025\/02\/AdobeStock_473725876-edited-2048x1151.jpeg 2048w\" sizes=\"auto, (max-width: 2560px) 100vw, 2560px\" \/><\/figure>\n<\/div>\n\n\n<p>Par un arr\u00eat en date du 28 d\u00e9cembre 2024 (n\u00b023-16.280), la Chambre sociale de la Cour de cassation a jug\u00e9 que lorsque le salari\u00e9 informe l&#8217;employeur de son invalidit\u00e9 cat\u00e9gorie II sans toutefois manifester sa volont\u00e9 de ne pas poursuivre le contrat de travail, l&#8217;employeur est tenu d&#8217;organiser une visite de reprise laquelle met fin \u00e0 la suspension du contrat de travail.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-style-default is-layout-flow wp-block-quote-is-layout-flow\">\n<p>&#8220;Il r\u00e9sulte de ces textes que, d\u00e8s lors que le salari\u00e9 informe son employeur de son classement en invalidit\u00e9 de deuxi\u00e8me cat\u00e9gorie sans manifester la volont\u00e9 de ne pas reprendre le travail, il appartient \u00e0 celui-ci de prendre l&#8217;initiative de faire proc\u00e9der \u00e0 une visite de reprise, laquelle met fin \u00e0 la suspension du contrat de travail.<\/p>\n\n\n\n<p>Pour d\u00e9bouter la salari\u00e9e de ses demandes de dommages-int\u00e9r\u00eats pour ex\u00e9cution d\u00e9loyale du contrat de travail et de r\u00e9siliation judiciaire, l&#8217;arr\u00eat retient que l&#8217;int\u00e9ress\u00e9e ne peut reprocher \u00e0 l&#8217;employeur une absence de reclassement sur un autre poste durant son arr\u00eat maladie, qui perdure toujours, alors que la mise en oeuvre d&#8217;une mesure de reclassement suppose un avis d&#8217;inaptitude donn\u00e9 dans le cadre de la visite de reprise qui a lieu lorsque l&#8217;arr\u00eat de travail se termine, ce qui n&#8217;est pas le cas en l&#8217;esp\u00e8ce.<\/p>\n\n\n\n<p>En statuant ainsi, alors que la salari\u00e9e soutenait qu&#8217;elle avait inform\u00e9 l&#8217;employeur de son classement en invalidit\u00e9 de deuxi\u00e8me cat\u00e9gorie, la cour d&#8217;appel a viol\u00e9 les textes susvis\u00e9s&#8221;.
