En effet, le salari\u00e9 avait une forte implication dans le recrutement, les profils des salari\u00e9s appel\u00e9s \u00e0 exercer les fonctions op\u00e9rationnelles au sein des deux soci\u00e9t\u00e9s \u00e9taient identiques, le salari\u00e9 utilisait des informations et le syst\u00e8me d\u2019information mis \u00e0 sa disposition par la soci\u00e9t\u00e9 employeur pour les activit\u00e9s de recrutement de l\u2019autre soci\u00e9t\u00e9 et avait propos\u00e9 des candidatures initialement destin\u00e9es \u00e0 la soci\u00e9t\u00e9 employeur :<\/p>\n\n\n\n<figure class=\"wp-block-pullquote\"><blockquote><p>\u00ab En statuant ainsi, alors qu&#8217;il r\u00e9sultait de ses constatations que le salari\u00e9 avait travaill\u00e9 pour une soci\u00e9t\u00e9 tierce, au profit de laquelle il avait recrut\u00e9 des salari\u00e9s en utilisant les moyens et informations fournis par son employeur, d\u00e9bauch\u00e9 des salari\u00e9s employ\u00e9s par ce dernier et d\u00e9tourn\u00e9 des candidatures adress\u00e9es \u00e0 son employeur, en sorte que l&#8217;intention de nuire \u00e9tait caract\u00e9ris\u00e9e, la cour d&#8217;appel qui n&#8217;a pas tir\u00e9 les cons\u00e9quences l\u00e9gales de ses constatations a viol\u00e9 le texte susvis\u00e9 \u00bb .<\/p><cite>(Cass.
