{"id":12288,"date":"2024-02-14T13:31:09","date_gmt":"2024-02-14T13:31:09","guid":{"rendered":"https:\/\/abeille.law\/?p=12288"},"modified":"2024-04-05T07:52:27","modified_gmt":"2024-04-05T07:52:27","slug":"convention-forfait-jour-pointage","status":"publish","type":"post","link":"https:\/\/abeille.law\/en\/convention-forfait-jour-pointage\/","title":{"rendered":"La validation d\u2019une journ\u00e9e de travail subordonn\u00e9e \u00e0 une pr\u00e9sence de six heures remet-elle en cause la validit\u00e9 du forfait-jours ?"},"content":{"rendered":"\n<h2 class=\"wp-block-heading has-medium-font-size\">Le salari\u00e9 soumis \u00e0 une obligation de pointage et \u00e0 une pr\u00e9sence de six heures pour valider une journ\u00e9e de travail ne dispose d\u2019une r\u00e9elle autonomie, de sorte que sa convention de forfait-jours doit \u00eatre annul\u00e9e.<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Par un arr\u00eat en date du 7 juin 2023 (n\u00b022-10.196), la Chambre sociale s\u2019est prononc\u00e9e quant \u00e0 la validit\u00e9 d\u2019une convention de forfait-jours conclue avec un salari\u00e9 qui \u00e9tait soumis \u00e0 une obligation de pointage et dont la validation des journ\u00e9es de travail \u00e9tait subordonn\u00e9e \u00e0 une pr\u00e9sence de six heures. Pour la Cour de cassation, le salari\u00e9 ne disposait pas d\u2019une r\u00e9elle autonomie de sorte que sa convention de forfait annuel en jours devait \u00eatre annul\u00e9e.<\/p>\n\n\n\n<figure class=\"wp-block-pullquote\"><blockquote><p>\u00ab La cour d&#8217;appel, qui a constat\u00e9 que le salari\u00e9 \u00e9tait soumis \u00e0 une obligation de pointage lors de son entr\u00e9e dans l&#8217;usine, pour chaque demi-journ\u00e9e de pr\u00e9sence, donnant lieu \u00e0 des relev\u00e9s informatiques reprenant chaque jour les heures d&#8217;arriv\u00e9e et de d\u00e9part et le nombre d&#8217;heures travaill\u00e9es, et qu&#8217;une journ\u00e9e de travail, pour \u00eatre valid\u00e9e, devait comptabiliser six heures de pr\u00e9sence dans l&#8217;entreprise, a pu, abstraction faite des motifs surabondants critiqu\u00e9s par le moyen pris en sa quatri\u00e8me branche, en d\u00e9duire que le salari\u00e9 ne disposait pas d&#8217;une r\u00e9elle autonomie dans l&#8217;organisation de son emploi du temps pour \u00eatre \u00e9ligible \u00e0 une convention de forfait en jours \u00bb. <\/p><cite>(Cass.
