{"id":12265,"date":"2024-02-14T13:03:46","date_gmt":"2024-02-14T13:03:46","guid":{"rendered":"https:\/\/abeille.law\/?p=12265"},"modified":"2024-04-05T07:39:11","modified_gmt":"2024-04-05T07:39:11","slug":"quelle-methode-de-comparaison-des-remunerations-doit-etre-appliquee-dans-le-cadre-de-la-garantie-devolution-des-salaires-des-representants-du-personnel","status":"publish","type":"post","link":"https:\/\/abeille.law\/en\/quelle-methode-de-comparaison-des-remunerations-doit-etre-appliquee-dans-le-cadre-de-la-garantie-devolution-des-salaires-des-representants-du-personnel\/","title":{"rendered":"Quelle m\u00e9thode de comparaison des r\u00e9mun\u00e9rations doit \u00eatre appliqu\u00e9e dans le cadre de la garantie d\u2019\u00e9volution des salaires des repr\u00e9sentants du personnel ?"},"content":{"rendered":"\n<h2 class=\"wp-block-heading has-medium-font-size\">En mati\u00e8re de garantie de non-discrimination salariale des repr\u00e9sentants du personnel, la comparaison doit se faire annuellement, avec des salari\u00e9s relevant de la m\u00eame cat\u00e9gorie professionnelle et dont l\u2019anciennet\u00e9 est comparable.<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Par un arr\u00eat en date du 20 d\u00e9cembre 2023 (n\u00b022-11.676), la Chambre sociale de la Cour de cassation a pr\u00e9cis\u00e9 la m\u00e9thode de comparaison des r\u00e9mun\u00e9rations en mati\u00e8re de garantie d\u2019\u00e9volution des salaires des salari\u00e9s repr\u00e9sentants du personnel.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ainsi, selon la Cour de cassation, en l\u2019absence d\u2019accord collectif de branche ou d\u2019entreprise d\u00e9terminant des garanties d\u2019\u00e9volution aussi favorables, la comparaison doit \u00eatre effectu\u00e9e annuellement. Par ailleurs, la Cour de cassation pr\u00e9cise \u00e9galement que cette comparaison doit \u00eatre faite avec des salari\u00e9s relevant du m\u00eame coefficient dans une classification applicable \u00e0 l\u2019entreprise pour le m\u00eame type d\u2019emploi, embauch\u00e9s \u00e0 une date voisine ou dans la m\u00eame p\u00e9riode.<\/p>\n\n\n\n<figure class=\"wp-block-pullquote\"><blockquote><p>\u00ab Il en r\u00e9sulte qu&#8217;en l&#8217;absence d&#8217;accord collectif de branche ou d&#8217;entreprise d\u00e9terminant des garanties d&#8217;\u00e9volution de la r\u00e9mun\u00e9ration des salari\u00e9s mentionn\u00e9s \u00e0 l&#8217;article L. 2141-5-1 du code du travail au moins aussi favorables, la comparaison de l&#8217;\u00e9volution de leur r\u00e9mun\u00e9ration, au sens de l&#8217;article L. 3221-3 de ce code, au moins \u00e9gale aux augmentations g\u00e9n\u00e9rales et \u00e0 la moyenne des augmentations individuelles per\u00e7ues pendant cette p\u00e9riode par les salari\u00e9s relevant de la m\u00eame cat\u00e9gorie professionnelle et dont l&#8217;anciennet\u00e9 est comparable ou, \u00e0 d\u00e9faut de tels salari\u00e9s, aux augmentations g\u00e9n\u00e9rales et \u00e0 la moyenne des augmentations individuelles per\u00e7ues dans l&#8217;entreprise, doit \u00eatre effectu\u00e9e annuellement \u00bb <\/p><cite>(Cass.
