Soc. N\u00b021-21.946), la Chambre sociale a apport\u00e9 une pr\u00e9cision importante concernant la charge de la preuve du respect des dur\u00e9es maximales de travail des salari\u00e9s int\u00e9rimaires. En effet, s\u2019il \u00e9tait clairement \u00e9tabli que par principe la charge de la preuve des dur\u00e9es maximales de travail incombe \u00e0 l\u2019employeur, n\u00e9anmoins, s\u2019agissant des salari\u00e9s int\u00e9rimaires, la charge de la preuve repose sur l\u2019entreprise utilisatrice.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u00ab\u00a0<em>en statuant ainsi, sans constater que l\u2019entreprise utilisatrice justifiait avoir respect\u00e9 les dur\u00e9es maximales de travail pr\u00e9vues par le droit interne, la cour d\u2019appel a viol\u00e9 les textes susvis\u00e9s\u00a0\u00bb (Cass. Soc, n\u00b021-21.946)<\/em><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Il r\u00e9sulte de l\u2019article L1251-21 du Code du travail que&nbsp;l\u2019entreprise utilisatrice est responsables des conditions d\u2019ex\u00e9cution du travail pendant la dur\u00e9e de la mission.
